About the Service

Feedback Machine is a browser extension and web service that lets you and your teammates leave inline comments on websites and web apps. You can create an organization, invite teammates, leave threaded feedback pinned to specific page elements, and export your data.

Beta Software

The Service is currently offered as a beta. That means:

• Features may be added, changed, or removed without notice.
• The Service may have bugs, performance issues, or unexpected behavior.
• We may experience downtime, data loss, or interruptions.
• We may reset, migrate, or remove beta data at any time, though we'll make reasonable efforts to give notice before doing so.

You should not rely on the Service for any business-critical workflow during the beta period.

Free During Beta

The Service is free to use during the beta period. Teams that sign up during the beta will continue to have access to a free tier of the Service after the beta ends, subject to reasonable use limits we may define. We may introduce paid plans or paid features in the future, and these Terms will be updated when we do.

Eligibility and Accounts

To use the Service, you must:

• Be at least 16 years old (or the minimum age for online services in your jurisdiction, whichever is higher).
• Provide accurate information when creating an account.
• Keep your login credentials secure. You are responsible for all activity under your account.
• Notify us promptly if you believe your account has been compromised.

You may create an organization and invite others to join it. The person who creates an organization is responsible for the actions taken within it, including managing members and removing access when appropriate.

Your Content

You retain ownership of the feedback, comments, and other content you submit through the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, transmit, and process Your Content solely as needed to operate, maintain, and improve the Service for you and your team.

You are responsible for Your Content and for ensuring you have the right to submit it. Don't submit content that:

• Infringes anyone's intellectual property, privacy, or other rights.
• Is unlawful, defamatory, harassing, hateful, or threatening.
• Contains malware, exploits, or attempts to interfere with the Service or other users.
• Includes sensitive personal data of others (such as health, financial, or government ID information) that you are not authorized to share.

We may remove content that violates these Terms or that we reasonably believe creates legal or security risk.

Feedback on Third-Party Websites

The Service lets you leave feedback on websites and web apps that you do not own. You are responsible for ensuring your use of the Service complies with the terms of the websites you are reviewing, applicable laws, and any agreements you have with site owners or your team. We are not affiliated with the websites you give feedback on, and we do not endorse their content.

We do not modify the underlying third-party websites; comments are stored separately and rendered through the extension.

Acceptable Use

You agree not to:

• Use the Service to violate any law or third-party right.
• Reverse engineer, decompile, or attempt to extract the source code of the extension or service, except where this restriction is prohibited by law.
• Probe, scan, or test the vulnerability of the Service, or breach security or authentication measures, without our prior written permission.
• Use the Service to send spam, harass others, or interfere with anyone's use of the Service.
• Resell, sublicense, or commercially exploit the Service or its outputs without our written permission.

Our Intellectual Property

The Service, including the extension, website, branding, and underlying software, is owned by Feedback Machine and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted.

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DATA YOU SUBMIT WILL BE PRESERVED OR ACCURATE.

No Support Obligation

Support is provided on a best-effort basis during the beta and is not guaranteed. We make no commitment to respond to any specific request, fix any specific issue, or maintain any service-level standard. If we offer paid plans in the future, those plans may include defined support commitments — but those commitments will not apply to the free tier.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEEDBACK MACHINE AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions don't allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the smallest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Feedback Machine from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.

Termination

You may stop using the Service at any time and delete your account from your settings. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and indemnification) will survive.

Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, including features, integrations, and storage limits. Where reasonably possible, we will notify users of significant changes that affect their use of the Service.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date, and where appropriate we will notify you by email or in-app notice. Your continued use of the Service after changes take effect means you accept the updated Terms. If you don't agree, please stop using the Service.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle data.

Governing Law

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state and federal courts located in Ohio, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your country of residence.

Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
• Severability. If any part of these Terms is found unenforceable, the rest will remain in effect.
• No waiver. Our failure to enforce any right under these Terms is not a waiver of that right.
• Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
